Orange County DUI suspect sentenced to 9 years in prison

On January 10 at around 2:00 am, Matthew Van McDaniel crashed his Mercedes-Benz S550 into a tree at the James Musick Correctional Facility in Irvine. When Orange County Sheriffs tried to detain McDaniel he punched one in the face. McDaniel pleaded guilty to 2 felonies including aggravated assault on an officer and misdemeanor DUI charges. His nine year prison sentence is a negotiated plea deal with the Orange County District Attorney's office. McDaniel was facing 24 to 28 years in prison due to his prior felony assault with a deadly weapon. Painter Thomas Kinkade arrested for Driving Under the Influence

After filing for bankruptcy and facing lawsuits from a number of art gallery owners, Kinkade now faces misdemeanor drunk driving charges. Thomas Kinkade is perhaps best known as the "painter of light" focusing his art on landscapes and religious scenery. His company Pacific Metro filed for bankruptcy protection earlier this month after creditors and those seeking compensation on fraud claims were said to be owed millions. California Highway Patrol arrested Kinkade on suspicion of DUI when he was said to have violated a vehicle code. The downfall in the economy has left people hopeless with no way out. Can you be charged with a DUI without even driving a car?

Daryl Fleck admits to consuming a twelve pack of beer and then stumbling out of the house to sleep it off. With his keys in the center counsel and the driver's side car door wide open a neighbor alerted police when he found Fleck passed out. When police arrived they found Fleck sleeping, the hood of the car was cold and to top it off the car wouldn't even start. Fleck was charged with a DUI and had a BAC of .18%. He is facing probation of 5 years and 4 years in custody for sleeping in his legally parked car in front of his house. If you are charged with a DUI you are in violation of 2 counts: Vehicle section code 23152 (a) and (b). The first one is driving under the influence of drugs and/or alcohol and the 2nd count (b) is driving under the influence of a blood alcohol concentration (BAC) of .08 or higher.
