DUI Checkpoints are designed to protect both motorists and the general public from individuals who are driving under the influence. These DUI sobriety checkpoints are often funded by tax payers as well as state and federal agencies, so everyone is always eager to find out whether they are actually beneficial to the cities in which they are conducted in.
Just this week, a DUI checkpoint in Orange County screened around 700 vehicles, with over 1000 vehicles that actually passing through the check point. The checkpoint occurred in Costa Mesa on Bristol Street at Randolph Avenue near The Lab and The Camp which are two popular hangout locations for teens and adults.
Out of the 700 vehicles that were screened, only one motorist was arrested on suspicion of driving under the influence. Five individuals were asked to perform DUI field sobriety tests, 30 driver licenses were investigated, 10 vehicles were towed and 18 motorists received citations. According to the OC Register, one citation was given to the driver of a vehicle in which the passenger was seen throwing out a beer can as it approached the checkpoint; the passenger was subsequently arrested for an outstanding DUI warrant.
If you have been arrested for driving under the influence at a California DUI checkpoint, contact our Orange County DUI Defense Attorneys today. We will make sure that the checkpoint was done in accordance to specific DUI checkpoint guidelines to ensure that the arrest was done correctly.
Over the past several months, we have been chronicling Congressional efforts to shut down the DUI checkpoint applications (apps) offered by various smart phone providers. On June 8, Apple finally relented to the mounting pressure and updated the review guidelines for its App Store, USA Today reports.
Under the revised guidelines: "Apps which contain DUI checkpoints that are not published by law enforcement agencies, or encourage and enable drunk driving, will be rejected."
Google and Apple had initially refused to comply with a written request by several senators, including Harry Reid and Charles Schumer, to ban apps that help drivers find out where police are conducting sobriety checkpoints. It now appears that Google is the only hold out.
As we have continuously argued, DUI checkpoint applications serve as a powerful drunk driving deterrent. Publicizing the location of a California DUI checkpoint will often encourage a driver to designate a driver or call a cab rather than risk a DUI arrest.
For those of you that had been using an Apple DUI checkpoint application, we invite you to check out our Facebook California DUI Checkpoint page and OC DUI Checkpoint website.
If you plan on going out this weekend, please be aware of multiple DUI Checkpoints that will be held in several cities throughout California.
If you find yourself arrested during a DUI checkpoint, contact our Orange County DUI Defense Attorney as soon as possible.

The list below shows a few, but not all, DUI checkpoints that will be occurring. If you are arrested during a checkpoint, contact our Orange County DUI Defense Attorneys as soon as possible so that you can get the best representation and the best results.

California DUI checkpoints are designed to protect the public from those who have been driving under the influence. A typical California DUI sobriety checkpoint is announced prior to its commencement and usually occurs in areas that are known for frequent drunk drivers or are near popular areas that have many bars and can even include looking for motorists who are driving on a suspended license.
During a DUI checkpoint, officers look for signs of intoxication that include blurry or bloodshot eyes, slurred speech and even the scent of alcohol coming from the person or the car. If officers notice any of these signs, they will ask the motorist to step out of the vehicle and perform a DUI field sobriety test as well as a breathalyzer test to determine whether the driver is in fact driving under the influence of alcohol and or drugs.
Once a driver is determined to be under the influence, they will be then arrested and will face hefty fines and license suspensions. Unfortunately, many drivers tend to react different to an officer telling them that they may be driving under the influence or even be offended that the officer is asking to see their license. An article on North County Times is a good example of how a regular DUI checkpoint can go wrong, causing additional drama and potential hefty when it could all have been avoided.
If you have been arrested for driving under the influence in Vista or in any other city, contact our California DUI Defense Lawyers today.
Orange County's Memorial weekend was filled with beach goers and friends gathering to celebrate with drinks and barbeques. From Friday to Monday, multiple DUI checkpoints could be seen throughout the county, checking to make sure motorists were not driving under the influence.

The OC Register reports that 148 individuals were arrested during these DUI checkpoints and saturation points, making that a higher number of those arrested than during last year's enforcement period. Although there were plenty of OC DUI checkpoints throughout, they were not enough to stop fatal DUI-related accidents from occurring. In Irvine, a 14 year old girl lost her life after drunk driver crashed his vehicle into the one the girl was in; two OC residents died in another DUI-related accident in Riverside County and a 25-year-old drunk pedestrian was struck by an SUV while he was crossing the road.
Driving under the influence is a serious matter that can hurt innocent people; if you plan on going out, please drink responsibly and always have a designated driver. Our Orange County DUI Defense Attorneys send their condolences to the friends and family members of the victims.
Happy Memorial Weekend! If you plan on going out this weekend, please drink responsibly and have a designated driver on hand. Multiple cities up and down California will be conducting DUI sobriety checkpoints starting today through Memorial Day. Below is a list of a few CA DUI checkpoints but it is not a complete.

A new bill will emerge that will oblige police officers to stick to specific guidelines when conducting DUI sobriety checkpoints. Unfortunately, it seems as if DUI checkpoints, which are meant to catch those who are driving under the influence, are being used as a way to make more revenue while using tax payer's money to pay for the check point itself.
Although police officers know the guidelines that should be followed, they tend to make up their own rules. By doing this, officers are able to arrest and impound more vehicles than there are actually DUI offenders. In 2009 alone, 24,000 vehicles were impounded which is 7 times more than the 3,200 DUI offenders that were arrested.
This new bill will ensure that guidelines and procedures are followed. According to the Pasadena Star News, these guidelines will include: establish a neutral formula for inspecting motorists, use proper lights and warning signs, perform DUI checkpoints during appropriate times, notify the public of the DUI checkpoint 48 hours prior and refrain from impounding vehicles of unlicensed drivers.
If you are arrested during a California DUI checkpoint, contact our Orange County DUI Lawyers as soon as possible; we will investigate to make sure that the check point was done according to the specific guidelines and if we find a discrepancy, we will take it to court and get you the best possible result.
Our Orange County DUI Attorneys understand that being arrested during a DUI checkpoint can be frustrating. Many DUI sobriety checkpoints are conducted poorly and against specific guidelines and therefore, our OC DUI Lawyers may be able to help you get the best possible result from your DUI case. The list below is designed to provide you with a few, but not all, DUI sobriety checkpoints that will be occurring starting today, Thursday May 12 and going through Sunday May 15th. As reported by several media outlets, police in Plainville, Connecticut, got a surprise when they were conducting a DUI checkpoint last week: a baby!
According to WHDH, Trevor and Bethel Hairston were home on Saturday night when Bethel confirmed it was time to go to the hospital.
The couple got in their car and headed for the hospital in New Britain, but they encountered a sobriety checkpoint.
When police stopped Trevor Hairston and his wife Bethel, they were immediately informed that she was in labor and may be on the verge of delivery.
Although police called an ambulance to the scene, it soon became clear that it would not arrive in time. Ultimately, several officers delivered the Hairston's baby in the front seat of their car.
"They came over and said the baby's crowning. The baby's here," said Bethel Hairston.
At 1 a.m., 10 minutes after they entered the checkpoint, Christian Hairston was born, weighing 5 pounds, 7 ounces.
Unfortunately, not every driver's encounter with a DUI checkpoint will be so joyous.
If you have been arrested for suspicion of driving under the influence at a California sobriety checkpoint, it is imperative to contact an experienced California DUI defense attorney.
Orange County DUI Checkpoints are designed to protect the public as well as other motorists from potentially fatal accidents. However, many times these DUI sobriety checkpoints cause more of a headache for motorists and do not net as many DUI offenders as officials would like. Tax payers' money ends up going towards these checkpoints but is it really worth it?
A great example comes from this weekend's OC DUI checkpoint that occurred in Irvine, at Campus Drive and Bridge Road. The DUI checkpoint was scheduled for several hours near the university where one would imagine many college age kids drinking and driving. According to the OC Register, officers stopped 545 vehicles during the scheduled OC DUI checkpoint. Out of almost 600 vehicles that passed through, officers conducted 9 DUI sobriety field tests and only arrested 2 DUI offenders.
Contact our Orange County DUI Attorneys if you have been arrested during a DUI checkpoint in or around Orange County.

A Costa Mesa DUI checkpoint resulted in six motorists being arrested for driving under the influence over the weekend.
Out of 2,127 vehicles that passed through the Newport Boulevard & 17th Street DUI Checkpoint, only 611 were actually screened. Out of these 611, only 6 were arrested for a DUI, 9 were asked to perform DUI field sobriety tests, 12 had their licenses investigated, 13 received citations and 11 vehicles were towed. The DUI checkpoint was paid for by a grant from the California Office of Traffic Safety and although these checkpoints are designed to protect the public from drunk drivers, they usually do not catch as many DUI drivers as one would expect and e nd up making the city money.

As we have previously discussed on this blog, vehicles are being impounded at California DUI checkpoints at an alarming rate, particularly when compared to the small number of DUI arrests.
This has raised concern that California DUI checkpoints are not achieving their intended purpose--deterring drunk driving--but rather generating huge profits for cities and town at the expense of unlicensed drivers.
Statistics collected by the Investigative Reporting Program at UC Berkeley reveal that several Southern California cities account for a disproportionate number of these impounds.
Here are the numbers-

As reported by CNET News, several members of Congress have sent a letter to Apple Inc. requesting that it remove applications that alert users to the presence of DUI sobriety checkpoints.
The letter was sent by U.S. Senators Harry Reid (D-Nev.), Charles E. Schumer (D-N.Y.), Frank Lautenberg (D-N.J.), and Tom Udall (D-N.M.) and was addressed to Apple's senior vice president of iPhone software, Scott Forstall.
The letter highlights apps that "contain a database of DUI [driving under the influence] checkpoints updated in real-time" as well as one that sends out real-time alerts about the existence of these checkpoints.
The senators claim that "providing access to iPhone and iPad applications that alert users to DUI checkpoints is harmful to public safety."
Apple has not yet issued a public response.
It is important to point out that not everyone necessarily shares the senators' opinion regarding DUI checkpoint applications. District attorneys, police officers, and even officials at Mothers Against Drunk Driving have all voiced their approval of such services as a powerful DUI deterrent.
The senators' letter also does not seem to consider that law enforcement officials are required by law to publically announce certain information about the locations of future DUI checkpoints. Many of these applications simply gather this information and share it with the public.
California drivers who wish to be informed of California DUI checkpoints have no need to worry about Apple's policy regarding these applications. The locations of California DUI checkpoints are always available on this blog as well as Twitter.
Residents of Orange County can also visit the Orange County DUI Checkpoints website to find out about checkpoint locations.

Were you arrested during a California DUI checkpoint? If so, contact our Orange County DUI Defense Lawyers immediately to find out how we can help you.
A Santa Barbara Superior Court Judge is being asked to rule that California DUI checkpoints are being illegally operated.
If the judge determines that this is the case, it will not only change how California DUI checkpoints are operated in the future (if at all), but will likely result in a number of DUI convictions being overturned where the arrests were made at these sobriety roadblocks.
In 1990, the U.S. Supreme Court ruled that DUI checkpoints are legal, as long as the officers overseeing the checkpoints follow a variety of very specific procedures.
The current Santa Barbara case is based on the argument that officers are not following these procedures and, therefore, previously conducted checkpoints that failed to comply with these rules were illegal. The case also argues that any checkpoints going forward must be in strict compliance, otherwise, they will be deemed illegal as well.
If you or someone you know has been arrested for suspicion of driving under the influence in California at a sobriety checkpoint, contact our California DUI attorneys today.

Over the weekend, Costa Mesa's DUI checkpoint resulted in four drivers being arrested on suspicion of driving under the influence.
According to the OC Register, 22 people performed DUI field sobriety tests, 11 cars were towed, 18 people were cited for multiple driving violation and 17 driver's licenses were investigated. This checkpoint was funded by a grant from the Office of Traffic Safety and out of the 429 vehicles that traveled through the checkpoint, only 1% of them were actually related to DUIs. This raises the question on whether these checkpoints are an effective means of protecting the public or whether taxpayer's money should be spent in a better way.
