        <![CDATA[A 17-year-old California teen has been arrested and booked on suspicion of driving under the influence after he caused a <a href="http://www.californiaduiguide.com/California-DUI-Law/California-DUI-Information/Vehicle-Defenses-CA.aspx">fatal DUI-related accident</a>.The crash occurred late Thursday evening in the city of Applegate, CA and took the lives of three passengers including Luke Edward Warren, 21, Daniel Silverman, 31, and Christian Mayorga, 21.  A fourth passenger, a 17-year-old female from Oregon, was taken to the local hospital with moderate injuries and is expected to survive.  
According to an article on Colfax Record, the accident occurred just past a tunnel, on a road that goes downhill and cautions drivers to slow down.  Evidence of skid marks was found just before the tree where the vehicle crashed into.

<p>According to <a href="http://blogs.laweekly.com/informer/2011/08/police_car_malibu_sand_beach.php">LA Weekly</a>, the alleged drunk driver was driving a grey BMW 550 when he rear-ended the patrol car, sending it more than 20 feet down an embankment and onto the beach. The <strong>California DUI accident</strong> occurred at about 1 a.m. last Saturday in the 19400 block of PCH near Las Tunas Canyon, according to a sheriff's statement.</p>

<p>The deputies had stopped to conduct a "safety sweep of the beach" on foot, according to the statement. When they returned to the patrol car, it was hit from behind.</p>

<p>The deputies were trapped in the vehicle, requiring rescuers to use hydraulic saws and jaws to get them out. One of the deputies suffered serious injuries and was hospitalized, while the other suffered minor injuries and was treated and released within hours, according to sheriff's officials.</p>

<p>Meanwhile, the alleged drunk driver, Mark Liebrecht, 44, was arrested on suspicion of <strong>California felony DUI</strong>. He also suffered injuries and was hospitalized, according to the sheriff's statement. His bail was set at $100,000.</p>

Therefore, before you head out to celebrate this holiday weekend, please read the following tips for avoiding a <strong>California DUI</strong>:</p>

<ul>
	<li>Call a taxi or designate a sober driver. It's that simple. If everyone followed this advice, we wouldn't need to provide the additional tips.</li>
	<li>Be informed. You can find information about California DUI checkpoints on <a href="https://www.facebook.com/California.DUI.Checkpoints">Facebook</a> or, for specific information for Orange County, the <a href="http://http://www.ocduicheckpoints.com/category/oc-dui-checkpoints/">Orange County DUI Checkpoints</a> website.</li>
	<li>Stay calm. Clearly, this is easier said than done. An Orange County DUI checkpoint or DUI stop is nerve-wracking. To avoid the appearance of fumbling for your license and registration, it is important to make sure they are easily accessible.</li>
	<li>Be polite. Roll the window down and place your hands on the wheel until the officer gets to your window. Wait until asked to reach for your documents.</li>
	<li>Don't volunteer information. Resist the urge to talk your way out an arrest. This almost always does more harm than good. If the officer suspects that you have been drinking, he or she will often ask, "How much have you had to drink?" It is important to realize that you are under no obligation to volunteer this information. Simply return the question with one of your own. You might ask why he or she is asking you this question or if the officer would like to see your documents. If the officer asks again and you think you may be over the legal limit, it is best to invoke your right to speak with an attorney before answering any further questions.</li>
	<li>Say no to field sobriety tests. If the police officer asks you to step out of the vehicle, you must comply. However, you do not have to perform any field sobriety tests such as walking on a line or touching your nose with both hands. If you think the tests may give the officer any reason to suspect you are impaired, politely decline to perform them.</li>
	<li>Delay the breath test. You should also refuse the Preliminary Alcohol Screening (PAS) Test. The PAS test is similar to a Breathalyzer and is used in the field prior to arrest. Unless you are under 21, there is no penalty for refusing the PAS Test. This is not to be confused with a chemical breath test or blood test, which is administered after arrest and is required by law.</li>
	<li>If you're arrested, submit to a breath test. At the police station, you will again be asked to submit to chemical testing. Under California's implied consent law, you must submit to a breath or blood test. Failure to do so after you are arrested for an Orange County DUI will result in harsher penalties such as jail time and loss of your driver's license for up to one year or more.</li>
</ul>

Many drivers are likely aware of electronic monitoring thanks to celebrities such as Lindsay Lohan, who was actually busted for driving under the influence while wearing a monitoring device. The truth is that the <a href="http://www.californiaduiguide.com/California-DUI-Law/CA-DUI-Alternative-Sentencing.aspx">DUI sentencing alternative</a> is not just for celebrities. In fact, it is one of the best ways for drivers who are convicted of driving under the influence to avoid jail time.

How Does It Work?

Electronic monitoring involves having the DUI offender wear an ankle or wrist bracelet that electronically monitors the individual's whereabouts while under some form of house arrest. The device sends a signal to a computer either at the probation office or to a monitoring contractor. The signal indicates whether or not the DUI offender is in compliance with the terms of the probation. 

Some electronic monitoring alternatives require DUI offenders to respond to periodic phone calls in order to insure that they are in compliance with the house arrest.  Other alternatives sometimes involve the use of global positioning systems (GPS) that monitor and record whether or not the individual stays within permitted areas. 

Generally, DUI offenders are allowed to continue to go to work, attend school, go grocery shopping, attend court-order alcohol programs, etc., typically during the day, with the requirement that they are at home during the evening when most drunk-driving arrests occur.  

If DUI defendants deviate from these specific restrictions, then it is a violation of the terms of their probation, and they will likely have to serve jail time. 
Who Is Eligible?

This option is generally offered as a condition of probation and allows those convicted of a drunk driving offense to avoid jail by limiting when and where they can go.

Other types include the "horizontal gaze nystagmust test" (where you are asked to follow an object with your eyes only), the "alphabet test" (where you may be asked to recite part of the alphabet) or even a counting test (where you must count backwards from a certain number, either odds or evens or any other combination) just to name a few.
How do FSTs affect you?

Although most arresting officers claim to be trained in administering DUI field sobriety test, most tests and results are based heavily on the officer's own opinion.  Because of this, even if you believe you have passed the field sobriety test, an officer might arrest you due to the fact that they suspect you are under the influence.
