Crash Highlights Dangers of California Motorcycle DUI

cyclehandlebr.jpgAs reported by the Daily Breeze, a motorcyclist killed Sunday in a crash on the Santa Monica (10) Freeway near West Los Angeles ran into the rear of another motorcyclist. Both motorcyclists were thrown from their vehicles and hit the pavement, according to the California Highway Patrol.

The motorcyclist who died was a 23-year-old Burbank man. He was found unconscious and was taken to UCLA Medical Center, where he was pronounced dead.

The second motorcyclist was a 29-year-old resident of North Hollywood. He was treated for injuries at UCLA Medical Center and placed under arrest for California DUI, according to the CHP.

This story should remind motorcyclists about the dangers of drinking and driving. California DUI arrests can be made against any motorist driving while under the influence of alcohol, whether that person is in a car or on a motorcycle.

Furthermore, motorcycle drivers comprise the highest percentage of drunk drivers in fatal crashes, often because motorcyclists' bodies are less protected from collisions.

If you have been arrested for a California motorcycle DUI, you will need an experienced California DUI attorney.

California DUI Suspect Crashes Three Times Before He Is Finally Arrested

Beer-Can-DUI.jpgAs reported by SonomaNews.com, a Sonoma man was arrested for California DUI after crashing his 1998 Chevy Suburban--not once--but three times.

The first DUI accident occurred when the man reared-ended another motorist on Arnold Drive, according to Officer Jaret Paulson with the California Highway Patrol's Napa office.

After fleeing the scheme of that accident, he proceeded into Seven Flags Mobile Home Park. Shortly thereafter, while driving on Hermosa Parkway, he hit a tree.

The DUI suspect then hit a stop sign on Seven Flags Circle and fled from his vehicle on foot to a residence on English Flag Way.

Because witnesses had reported seeing him with a gun, the Sonoma deputies and CHP set up a perimeter and called for assistance from the CHP helicopter in Napa.

The suspect was eventually arrested and charged with three counts of misdemeanor hit-and-run, misdemeanor driving under the influence, and misdemeanor driving while suspended.

This California driver will likely be found in violation of his DUI probation and could face harsh penalties from the criminal court system.

If you arrested for driving on a suspended license, the first thing you should do is contact a qualified California DUI Defense Attorney.

A Costa Mesa DUI checkpoint resulted in six motorists being arrested for driving under the influence over the weekend.

Out of 2,127 vehicles that passed through the Newport Boulevard & 17th Street DUI Checkpoint, only 611 were actually screened. Out of these 611, only 6 were arrested for a DUI, 9 were asked to perform DUI field sobriety tests, 12 had their licenses investigated, 13 received citations and 11 vehicles were towed. The DUI checkpoint was paid for by a grant from the California Office of Traffic Safety and although these checkpoints are designed to protect the public from drunk drivers, they usually do not catch as many DUI drivers as one would expect and end up making the city money.

Southern California Cities Lead State in Impounds at DUI Checkpoints

DUI checkpoint.jpgAs we have previously discussed on this blog, vehicles are being impounded at California DUI checkpoints at an alarming rate, particularly when compared to the small number of DUI arrests.

Here are the numbers-

Program Teaches Teens Effects of DUI

Several high school teens are being presented with a graphic visual stimulation of a drunk driving accident to help them understand the horrors of driving under the influence.

The program "Every 15 Minutes" is dedicated to making sure teens learn the severity of consequences that are associated with drinking and driving or even texting and driving. According to Parent Dish, once teens watch a simulation of a DUI accident on the school parking lot, a masked Grim Reaper pulls selected students out of class every 15 minutes to symbolize their death due to a DUI and an officer reads an "obituary" to the class that was written by that student's parents. For the next 24 hours, selected "dead" students cannot make any phone calls, text or even speak. This program teachers teens the dangers of driving under the influence or driving while texting to ensure their safety as well as the safety of other motorists.

California DUI keys.JPGAs reported by the Belmont Shore Patch, a Long Beach police officer has been sentenced to community service after pleading guilty to misdemeanor DUI.

Officer Eddie Sanchez, 30, was also ordered to complete three months of first-offender alcohol-awareness classes and to attend a Mothers Against Drunk Driving Victim Impact Program, according to the Orange County District Attorney's Office. Sanchez also received three years of informal probation.

According to the district attorney, on May 24, 2010, Sanchez left a Long Beach bar about 4:30 p.m. Witnesses reported that he was driving erratically before stopping at a red light in Garden Grove. He idled there after the light changed to green and even after drivers began honking at him. Finally, a motorist walked up to his car, reached inside, and turned off the ignition. Sanchez's blood-alcohol level was measured at .16, twice the legal limit, the prosecutors maintained.

This case highlights that courts are increasingly utilizing sentencing alternatives in lieu of jail time. The MADD Victim Impact Programs sentencing alternative as well as some others are more specifically designed to help rather than punish California DUI offenders.

Fullerton Man Causes Head-on Crash, Arrested for Felony DUI

Faustino Barcenas, 49, has been arrested for a felony California DUI after causing a head-on collision.

The Fullerton resident was driving west on Highway 46 at around 11:15pm when he drifted into the eastbound lane. A driver in a Nissan Altima witnessed Barcenas drifting and pulled over on the side of the road to avoid a collision; Barcenas sideswiped the Altima before continuing down the road where he then struck Maria DeJesus Garcia, 37, head-on. Garcia and Barcenas both had to be extricated from their vehicles and be transported to nearby hospitals as they suffered major injuries.
