Florida Motorist Arrested Twice for DUI While Sober



While completely sober Joseph Errichiello was charged with drunk driving on two separate occasions due to failing field sobriety tests.  Both his breath alcohol and urinalysis came back negative each time.  This continues the debate on the inaccuracies field sobriety tests can create on proving one's level of intoxication.

Officer Found Not Guilty of Drunk Driving Charge



James Scesny, a Maccachusetts police officer, was found not guilty in a drunk driving case because the judge threw out his blood alcohol results.  The judge agreed with Scesny's lawyer that these results were taken without Scesny's consent and were therefore inadmissible in court.  Scesny was then only ordered to pay $200 in court fees and $50 in victim witness assessment.
